Tamarack Solar Energy LLC has appealed a court ruling that upheld the Marshall County Board of Zoning Appeals’ denial of the company’s special-use request.
County Attorney Sean Surrisi updated Marshall County Commissioners Monday, saying the county received notice of the appeal on October 29.
The September 30 ruling denied Tamarack’s Petition for Judicial Review and affirmed the BZA’s denial of Special Exception Use Application 24-BZA-45.
According to court documents, Tamarack’s appeal also challenges two earlier court orders involving discovery and the court’s decision to send the case back to the BZA for more detailed findings of fact.
The Notice of Appeal requests transcripts from hearings held July 1, 2025 and July 9, 2026.
Surrisi said the appellate briefing process is expected to continue into 2027 and told commissioners he remains confident in the county’s legal position.
