South Bend Police responded to the 1000 block of College Street for a reported shooting and found 33-year-old Alberto Soto Rodriguez suffering from apparent gunshot wounds. He was pronounced dead at the scene.

The South Bend Police Department’s Violent Crimes Unit took over the investigation.

According to police, investigators collected witness statements and video evidence indicating Alberto Soto Rodriguez and his brother, 36-year-old Pedro Rodriguez Soto, were reportedly attempting to break into the residence where the shooting occurred.

Witnesses told investigators both men were armed.

Residents reported hearing the two men break into the home and enter through the kitchen. One resident shouted for the intruders to leave and warned that the residents were armed.

The residents then reported seeing a man enter the living room and point a firearm at them while they were standing in the stairway. One resident began firing at the intruder and believed the intruder was also firing.

Police said ballistics evidence confirmed one of the intruders fired a semi-automatic handgun from the area described by the residents.

According to investigators, a van later pulled into the alley near a side door of the home. One intruder was reportedly seen dragging the other toward the van.

Residents told police one of the intruders then reached into his waistband and pointed a firearm at them. The residents said they fired again from an upstairs window.

Pedro Rodriguez Soto later arrived at a hospital and reportedly said he had been injured during a possible robbery or home invasion. He also stated that he and his brother had been doing landscaping nearby.

Investigators later determined Pedro Rodriguez Soto was injured by debris during the incident but was not struck by gunfire.

Following the investigation and collaboration with the St. Joseph County Prosecutor’s Office, Pedro Rodriguez Soto was arrested and charged with:

● Two counts of Murder - Aiding, Inducing or Causing an Offense

● Two counts of Burglary involving serious bodily injury and a dwelling - Aiding, Inducing or Causing an Offense

● Two counts of Burglary with a deadly weapon - Aiding, Inducing or Causing an Offense

● Two counts of Burglary of a dwelling - Aiding, Inducing or Causing an Offense

● Intimidation

Pedro Rodriguez Soto is being held at the St. Joseph County Jail.

All persons are presumed innocent unless and until proven guilty in a court of law.
